Denial Letters
Under Florida law, license denial letters issued by the Department of Financial Services are generally considered public records. This is in accordance with Florida’s Public Records Law, Chapter 119, Florida Statutes.
Section 119.011(12), F.S., defines public records to include all documents, papers, letters, or other materials made or received by a state agency in connection with official business. Because license denial letters are created as part of the Department’s regulatory responsibilities, they fall within this definition.
Section 119.07, F.S., requires agencies to make public records available for inspection and copying by any member of the public, unless a specific exemption applies. While the content of license denial letters is generally public, certain information—such as Social Security numbers, financial account details, or sealed or expunged criminal history—may be redacted in accordance with Section 119.071, F.S., which outlines exemptions designed to protect sensitive personal data.
License denial letters issued on or after January 1, 2024, are published below for public access. For denial letters issued prior to January 1, 2024, a public records request must be submitted through the Department’s portal at https://fldfs.justfoia.com/publicportal/home/track.
