Notice of Receivership
On December 10, 2014, Florida Healthcare Plus, Inc. ("FHCP") was ordered into receivership for purposes of rehabilitation by Judge George S. Reynolds III of the Second Judicial Circuit Court in Leon County, Florida. The Florida Department of Financial Services is the court appointed Receiver of FHCP. On January 1, 2015 FHCP was ordered liquidated by the Court.

Background Information

FHCP was a health maintenance organization that obtained its Florida license in 2007. Headquartered in Coral Gables, Florida, FHCP was a Medicare & Medicaid HMO of approximately 9,000 subscribers. Medicare and Medicaid premiums and contracts are administered through a federal agency, the Centers for Medicare and Medicaid Services (CMS).

Special Election Period
As a result of the receivership of FHCP, all Medicare beneficiaries enrolled in FHCP had a Special Election Period through February 28, 2015 to enroll in a plan of their choosing. All dual eligible or those eligible for the Low Income Subsidy could enroll in another plan at any time. A beneficiary that selected another Medicare Advantage or Medicare Advantage-Prescription Drug plan was covered under the new plan effective the first day of the next month after they enrolled. Notice of Determination

On May 24, 2018, a Court Order was signed approving a Second Interim Claims Report for Florida Healthcare Plus, Inc. On June 7, 2018 the Department mailed 22 Notices of Determination to claimants advising them of the results of the Department’s evaluation of their claim and the process for filing an objection, if any, to the evaluation results. The court ordered deadline for filing an objection is July 12, 2018. Objections filed after the deadline will not be accepted.


On January 20, 2017 a Court Order was signed approving the First Interim Claims Report for the Florida Healthcare Plus, Inc. receivership. Notices of Determination were sent out on all evaluated claims in classes 2-8.

Distribution

​Distribution checks were mailed on January 30, 2019, for fully adjudicated claims. Distributions were made at 55.84% of the recommended amounts in the class 2 (Loss) claimants. Refer to Florida Statute 631.271 for additional information on the Priority of Classes. These approximately 1,700 checks are dated January 29, 2019, and are valid for 60 days from that date. Payees are strongly encouraged to cash their checks as soon as possible. A notice accompanies each check advising the payee that the check is not valid after the time period specified on the front of the check. There will be no reissues. This is anticipated to be the only distribution.

Estate Closed

​The Department was discharged of all of its responsibilities in administering this estate and the estate was closed at 11:59 PM on April 29, 2019.
