Notice Regarding 2023 Appointment Process for Appointment to The Board of Funeral, Cemetery and Consumer Services

Application Receipt Deadline:  Friday, June 30, 2023

The Board of Funeral, Cemetery, and Consumer Services (the “Board”) is created by section 497.101, Florida Statutes. In partnership with the Florida Department of Financial Services, Division of Funeral, Cemetery, and Consumer Services (the “Division”), the Board regulates the deathcare industry in Florida under Chapter 497, Florida Statutes.  The Board consists of 10 persons. The requirements for appointment to the Board are specified in section 497.101, Florida Statutes.  Pursuant to this section, when a vacancy on the Board occurs, Florida’s Chief Financial Officer (CFO) provides nominations for each position to the Office of the Governor and the Governor appoints Board members from among the CFO's nominees.  

The current term of appointment of the following four members of the Board is scheduled to expire on September 30, 2023.  The descriptions below, as applied to the four referenced positions, are from section 497.101, Florida Statutes.

Jay LyonsA principal of a monument establishment licensed under chapter 497, Florida Statutes, as a monument builder.

 

Each Board member whose term is expiring may seek reappointment. Pursuant to section 497.101, Florida Statutes, however, all applicants for the referenced positions will be considered.

The deadline for the Division’s receipt of applications is close of business on Friday, June 30, 2023.  To best meet this receipt deadline, the Division recommends that submissions be sent by email to Ms. Bryant in advance of the deadline.

Selected nominees will be notified by Chief Financial Officer Jimmy Patronis’ office and provided further instructions regarding the completion of the next phase of the application process.

Rules Committee Meeting

The Rules Committee of the Board of Funeral, Cemetery, and Consumer Services announces a public meeting on June 8, 2023, 1:00 p.m., to which all persons are invited. The meeting will take place at the Florida Department of Revenue Capital Circle Office Center (CCOC) conference room 2-1250 in Building 2, Tallahassee FL. Regarding Tropical Storm Nicole and Hurricane Preparations for Future Storms

Tropical Storm Nicole is expected to become a hurricane prior to making landfall along the east coast of Florida.  Since this is a large storm, many Florida counties will be impacted with wind and/or flooding issues.  In anticipation of inclement weather resulting from this or future storms, we want to remind our licensees of the following.  This information was also directly provided to our licensed establishments by email on Tuesday, 11/8/22.

1. Hurricane preparation and aftermath information

State, county, and city governments provide a lot of information on preparing for natural disasters, including hurricanes.  One great resource is found at the Department of Financial Services’ website at:  https://myfloridacfo.com/Division/Consumers/storm/.  You may also wish to visit https://www.floridadisaster.org/ for more information regarding general hurricane preparedness, including emergency planning for businesses at https://www.floridadisaster.org/business/planning-for-businesses/.  These sites also provide helpful information on filing claims and other issues that may arise after a storm.

2. Power outages

If you have a refrigeration unit, and your facility or unit is damaged or otherwise inoperable due to a hurricane or other natural disaster, please consider the following options:

  • Contact another local funeral establishment to see if they might have space available; or
  • Contact your local county emergency management.  Contact information for the Emergency Management Directors of each county is found in the document linked below, which was provided to us by the Florida Division of Emergency Management.  Your county emergency management will coordinate with the state’s emergency management team or others as may be necessary to assist you.

3. E-filing of Death Certificate Notices

At this time, the Electronic Death Registration System (EDRS) is not expected to be impacted by Tropical Storm Nicole.  We recognize, however, that your accessibility to the system may be limited due to power outages in your own areas.  The Florida Department of Health – Bureau of Vital Statistics recently sent an email to its list of funeral directors reminding them that licensees should print several blank copies of its death certificate form (DH512), fetal death form (DH428), and burial transit permit (DH326) in preparation for possible power outages and downtime.  If EDRS is not accessible for an extended period of time but power is available, then the aforementioned forms are available as an enterable pdf and may be used to complete the death record.  Please print the forms double-sided on legal sized (8 ½ x 14) paper. Once completed and signed, you may file the paper form at the local county vital statistics office for registration.

The Bureau of Vital Statistics Helpdesk (1-866-295-5902) has also advised that it is available: M - F 8am - 6pm, and Sat 9am - 2pm ET. Their Quality Assurance unit is also available at 904-359-6900 ext. 9020 and you may reach Ken Jones at 904-359-6900 ext. 1001.

4. Hurricane Follow-up

Following a hurricane, Division staff will be calling the licensed establishments in the impacted areas to obtain information on any power outage issues, building damages, etc., and determine if there are any needs with which we can assist.  If your establishment has refrigeration/storage space available at that time, please let our staff know so that they can share that information with other licensees in the area who may need that type of assistance.

5. Division of Funeral, Cemetery, and Consumer Services’ Offices

Office closures during the week will depend upon the path, duration, and impact of the storm.  If you have attempted to reach the Division at its main line (850-413-3039 or toll free in Florida at 1-800-323-2627) without success, please leave a message.  Division staff will return your call as soon as possible following the storm.

Regarding Hurricane Ian Post-Storm Issues and Hurricane Preparations for Future Storms

As the state deals with post-storm issues caused by Hurricane Ian, please keep in mind the information below.  This information was also directly provided to our licensed establishments by email on Tuesday, 9/27/22.  It is our hope that the information provided on the E-filing of death certificate notices, county emergency management contacts, and storm preparations will assist our licensees through the aftermath of Hurricane Ian and preparation for any future storms.

Notice Regarding CFO Directive 2020-12

Chief Financial Officer Jimmy Patronis has executed CFO Directive 2020-12. The directive promotes public health and safety by relieving certain requirements of Florida licensure for individuals who are active, out-of-state licensed deathcare professionals to enable these individuals to perform services related to the final disposition of human remains in Florida during this time of critical need.

Potential Additional Source for Personal Protective Equipment (PPE)

Many businesses licensed under Chapter 497, Florida Statutes, may now request various forms of PPE from the state’s Division of Emergency Management. The Division of Funeral, Cemetery, and Consumer Services is pleased to assist in this request process by reviewing and coordinating the licensees’ PPE requests with the Division of Emergency Management. To request supplies, licensees should carefully review and follow instructions contained in the  Information Regarding Requests for Personal Protective Equipment (PPE) from the Division of Emergency Management. Requesting licensees must also complete and submit the PPE Request Form by email as indicated on the form in order for their request to be considered. It is preferred that the form be completed electronically using Microsoft Excel.

There are several factors to consider before making a request. Businesses must first attempt to obtain PPE through their available supply chains before making a request. Additionally, since PPE quantities are limited in all occupations, businesses may not receive the PPE requested. As a result, businesses may want to continue pursuing other avenues for PPE, even after a request is made using this process. Finally, at some point, it is expected that licensees will be billed for any PPE supplies obtained from the Division of Emergency Management, just as they would if the supplies had been obtained through their private supply chain.

The PPE request process is the result of joint efforts between the Florida Department of Financial Services, the Division of Emergency Management, the state’s Emergency Operations Center, the Florida Department of Health, and Florida’s deathcare associations – the FCCFA, IFDF, FMA, and FMBA. Notice Regarding CFO Directive 2020-08

Chief Financial Officer Jimmy Patronis has executed CFO Directive 2020-08. The directive promotes public health and safety by suspending section 872.03, F.S., which imposes a 48-hour waiting period before human remains may be cremated. The Directive also suspends administrative rules limiting funeral establishments to using cremation, refrigeration, embalming, or removal services located less than 75 miles away. Finally, the Directive grants the Division of Funeral, Cemetery and Consumer Services the authority to approve limited licenses for retired professionals who were once licensed, in any state, as a funeral director, embalmer, combined funeral director and embalmer, or direct disposer during this time of critical need, as provided in section 497.143, F.S.

2019 Board Appointment Notice

The Board of Funeral, Cemetery, and Consumer Services implements regulation of the death care industry in Florida under Chapter 497, Florida Statutes. The Board consists of ten persons. The current term of four board members is scheduled to expire on September 30, 2019. Additionally, the Board has one current vacancy. While each member whose term is expiring may seek reappointment, all applicants for the expiring and/or vacant positions will be considered. Persons interested in applying for appointment or reappointment to the Board must follow the application process outlined in the documents below. The deadline for receipt of applications is close of business on Wednesday, July 31, 2019.

The License Review Committee of the Board of Funeral, Cemetery, and Consumer Services, operating under Chapter 497, Florida Statutes, hereby gives notice that it will hold a public meeting on Thursday, May 30, 2019, 10:00 a.m., at the Claude Denson Pepper Building, 111 W Madison Street #G-01, Tallahassee FL 32399 to discuss the licensure requirements of funeral directors.

Due to scheduling conflicts, the Public Workshop that was scheduled for September 12, 2018, in Tampa, Florida, has been cancelled. The Tampa workshop for stakeholders to provide input for legislative and policy changes has been rescheduled to take place on Wednesday, November 28, 2018, from 10:00 a.m. – 3:00 p.m. Depending upon the flow of the discussions, a brief break may be called around noon to permit attendees to have lunch.


The next Public Workshop will take place in Miami on Thursday, October 4, 2018, from 1:00 p.m. – 5:00 p.m. All written comments from industry representatives, which were received in preparation for the cancelled September workshop, will be discussed at the Miami workshop in October. In order to allow industry representatives additional time to submit comments for possible discussion for the Public Workshop, which will take place in Miami, we are extending the deadline for the submission of comments through close of business on Monday, September 17, 2018. Please submit your written comments, if any, via email to the attention of Mary Schwantes, Division Director at: mary.schwantes@myfloridacfo.com. All written comments received will be placed on the October 4th Public Workshop Agenda to allow time for open discussion of items. Please remember: the primary purpose of these workshops is to receive input from industry representatives on potential legislative issues relating to the death care industry.

NOTICE TO ALL PRENEED LICENSE RENEWAL FILERS

Please be advised that the initial renewal packets that were mailed out contained a misprint of the renewal deadline date as of July 1, 2018. The correct renewal deadline date is April 1, 2018. The Division will be mailing out revised renewal packets to Licensees correcting this misprint. All preneed renewal packets are due back to the Division by no later than April 1, 2018
