Claims Evaluation
Proof of claim forms have been mailed. Any proof of claim form filed after the claims filing deadline of June 29, 1993 was considered "late filed". If you have submitted a proof of claim form, you will be notified in writing of the Receiver's recommendation on your claim.
On February 7, 2011, the Second Interim Claims Report was filed with the Court in the estate of ICF. On February 8, 2011, the Court issued an order approving the report. The Second Interim Claims Report addresses claims filed in Classes 1 and 2. This claims report does not address the claims of the Commonwealth of Puerto Rico and the Puerto Rico Insurance Guaranty Association. Only claims in Classes 1 and 2, with the exception of Puerto Rico, were evaluated within the Second Interim Claims Report. On February 18, 2011, Notices of Determination ("Notices") were mailed to these claimants. The Notice informed them of the Receiver's recommendations concerning the classification and amount of their claim, along with instructions on how to proceed if a claimant objected to the recommendations. Objections were required to be filed by the claimant, in writing, with both the Court and the Receiver and postmarked by April 21, 2011. Objections filed after that date were not considered.
On September 19, 2011, the Third Interim Claims Report was filed with the Court in the estate of ICF. On September 26, 2011, the Court issued an order approving the report. The Third Interim Claims Report addresses certain claims filed in Classes 2, 3 and 5. On February 18, 2011, Notices of Determination ("Notices") were mailed to the 4,973 claimants impacted by the order. The Notice informed them of the Receiver's recommendations concerning the classification and amount of their claim, along with instructions on how to proceed if a claimant objected to the recommendations. Objections were required to be filed by the claimant, in writing, with both the Court and the Receiver and postmarked by December 2, 2011. Objections filed after that date were not considered.
On June 2, 2015, the Fourth Interim Claims Report was filed with the Court in the estate of ICF. On June 3, 2015, the Court issued an order approving the report. The Third Interim Claims Report addresses certain claims filed in Classes 1, 2, and 3. On June 11, 2015, Notices of Determination ("Notices") were mailed to the 6 claimants impacted by the order. Objections were required to be filed by the claimant, in writing, with both the Court and the Receiver and postmarked by July 31, 2015. Objections filed after that date were not considered.
On October 23, 2015, the Receiver filed a motion for approval of the Final Claims Report and the Claims Distribution Report, and to authorize a distribution to Class 1-3 claimants. The Court entered an order granting the motion on October 28, 2015. A distribution, totaling $10,596,395 and representing payment of 100% of the Class 1-3 claims, was made on November 25, 2015. The distribution consisted of 1,609 checks. The Receiver anticipates another distribution will be made to claimants in other classes at a later date.
On March 11, 2016, the Fifth Interim Claims Report was approved by Court order. The Fifth Interim Claims Report addressed the evaluation of the remaining Class 4, Class 5, Class 6, and Class 8 claims. The order approving the Fifth Interim Claims Report placed a deadline of April 29, 2016, for filing objections to the evaluations.
On May 5, 2016, the Receiver filed a motion for approval of the Final Claims Report and the Claims Distribution Report, and to authorize a distribution to Class 4-8 claimants. The Court entered an order granting the motion on May 12, 2016.. A distribution, totaling $1,221,882 and representing payment of 100% of the Class 4, 5,6, & 8 claims, was made on June 8, 2016. The distribution consisted of 470 checks.
The Department was discharged of all of its responsibilities in administering the ICF estate and the estate was closed at 12:01 AM on October 31, 2016.
